Talkon - Speech Script Generator

Welcome to Talkon. These Terms of Service ("Terms") govern your use of the Talkon application and services provided by Shanghai Hotidea Technology Co., Ltd. By accessing or using Talkon, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Talkon, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use Talkon.

2. Description of Service

Talkon is a speech script generation tool that allows users to generate personalized speech scripts based on selected scenes, styles, and durations. The service processes user inputs and generates corresponding speech content using AI technology.

3. Account Registration

You must sign in with a valid Apple ID to use Talkon. You agree to provide accurate information and keep your account credentials secure. You are solely responsible for all activities that occur under your account.

4. Subscription and Credits

4.1 Subscription Plans

• Monthly Subscription: 1,000 credits per month
• Yearly Subscription: 12,000 credits per year

4.2 Credit Usage

• Credits are consumed based on speech script generation requests
• Required credits = duration (in minutes) x 10
• Credits have no cash value and cannot be exchanged for money
• New users receive 30 complimentary credits upon registration

4.3 Subscription Management

Subscriptions are processed through the App Store. You can manage and cancel your subscription through your Apple ID account settings. Cancellation takes effect at the end of the current billing period. Credits will not be refunded upon cancellation.

5. Acceptable Use

You agree to use Talkon only for lawful purposes and in accordance with these Terms. You shall not:

• Use the service for any illegal or unauthorized purpose
• Generate content that promotes violence, hatred, discrimination, or harassment
• Infringe upon the intellectual property rights of others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the service or servers connected to the service
• Use automated tools to access the service without our permission

6. Intellectual Property

6.1 Our Content

All rights, title, and interest in Talkon, including but not limited to the application, design, logos, and trademarks, are owned by Shanghai Hotidea Technology Co., Ltd. or its licensors.

6.2 Your Content

You retain all rights to the content you create using Talkon. By using our service, you grant us a non-exclusive license to store and process your content as necessary to provide the service.

7. Service Availability

We strive to provide uninterrupted service, but we do not guarantee continuous availability. We may suspend or terminate the service at any time for maintenance, updates, or other reasons. We will make reasonable efforts to notify you of any significant service changes.

8. Limitation of Liability

To the maximum extent permitted by law, Shanghai Hotidea Technology Co., Ltd. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Talkon. Our total liability shall not exceed the amount you paid for the service in the twelve months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Shanghai Hotidea Technology Co., Ltd., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or your use of Talkon.

10. Modification of Terms

We reserve the right to modify these Terms at any time. Significant changes will be communicated through the app. Your continued use of Talkon after such modifications constitutes your acceptance of the updated Terms.

11. Termination

We may terminate or suspend your account immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use Talkon will cease immediately.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions.
